Samsung Patent Infringement of Apple iPhone 'Not Willful': Judge

Nonetheless, the world's largest device maker will still have to pay a hefty fine ($1 billion) for violating some Apple intellectual property.

Samsung celebrated a hard-fought legal victory Jan. 29 when a federal judge declared that the South Korean device maker's infringement of Apple iPhone design and utility patents was not a willful scheme. Nonetheless, the world's largest device maker will still have to pay a hefty fine for violating some Apple intellectual property. In a seven-page post-trial statement, San Jose, Calif.-based Judge Lucy Koh confirmed a $1 billion fine against Samsung for violating Apple's intellectual property while at the same time rejecting Apple?s bid for bonus damages in the months-long smartphone lawsuit. Apple had also sought court injunctions against Samsung against the sale of Samsung's 152 smartphones and tablets, including its popular Galaxy brand, in the United States. That request was denied by Koh in December. Back on Aug. 24, a federal court jury also presided over by Koh decided to punish Samsung with a $1.05 billion damages slap for ostensibly copying Apple's products. Koh's final decision found Samsung willfully in violation of seven of Apple?s design and utility patents. These covered the design of Apple's iPad and iPhone products, as well as essential user interface elements. One of the specific patents that jurors -- and Koh -- determined Samsung had copied from Apple is called the Bounce, which is what happens to content on the screen of any iOS device when a user scrolls down to the bottom of a page, and the page sort of "bounces" to let him or her know the end has been reached. Additionally, design items such as the curves on the edges of Samsung's smartphones and tablets were also cited as being "willfully" copied from Apple's products. Koh did not find that Apple infringed on Samsung?s intellectual property. Koh explained in her order that to constitute willful infringement, "Apple must prove by clear and convincing evidence that there was an ?objectively high likelihood that its actions constituted infringement of a valid patent.?? Koh decided that in each of the seven cases the violation was not willful. Back on Aug. 24, a federal court jury in San Jose, Calif. -- also presided over by Koh -- decided to punish South Korea-based Samsung with a $1.05 billion damages slap for ostensibly copying Apple's products. Apple made no qualms about going hard legally after Samsung, its Android operating system and the rest of the $219 billion smartphone and tablet market. It already owns about 62 percent of tablet sales with the iPad but it is facing a receding 17 percent of the smartphone market with the iPhone. Android, with 68 percent of the world smartphone market, has a huge advantage -- one that would take several years to supersede. Apple's main motivation for this case is that Android is kicking iPhone's rear all over the world. Android Inc. co-founder and Google Senior Vice President of Mobile and Digital Content Andy Rubin tweeted recently that more than 900,000 Android devices are activated each day.

Criminal Legal Aid Contributions, Professional Representation and ...

Yesterday evening the Scottish Parliament voted by a majority of 9 to pass into law the Scottish Civil Justice Council and Criminal Legal Assistance Bill into law.? The Bill will now be submitted to the Queen for Royal Assent.? It was a disappointing end to a hard fought campaign by a wide range of people to try and prevent Part 2 of that Bill being passed.? However, it was always going to be an impossible task with the Government having a majority in Parliament.

The first part of the Bill; the establishment of the Scottish Civil Justice Council, was generally uncontroversial and was the result of a lengthy piece of work submitted to the highest levels of scrutiny.? The Scottish Civil Justice Council came as a consequence to the review of civil justice in Scotland carried out by the now Lord President, Lord Gill.? It is a shame that this element of the Bill was overshadowed by the second part of the Bill.? Had the two been separate it is likely that the Scottish Civil Justice Council part would have received unanimous support in the Scottish Parliament.

The significant expansion of contributions to criminal legal aid as a result of this legislation will have a profound impact on justice in Scotland.? I?m not going to write at great length on the merits of the Bill as I have done that in a number of posts (and others have written elsewhere much more eloquently than I have).? The proposals will undoubtedly lead to a number of appeals under Article 6 of the European Convention on Human Rights (the right to a fair trial).? The Government and Presiding Office (presumably with legal advice) are both happy that the contents of the Bill are compliant with the European Convention on Human Rights; however, there is the very real possibility that the contributions system will begin to give rise to ?devolution minutes? once it begins to take hold in the system.? That will certainly be something to keep an eye out on to see what happens in that respect.

It is clear from speaking to practitioners in person and through social media that there is a very real anger over yesterday?s result.? It is just one of many things to have arisen over the last few years that have caused anger.? Some of that anger is directed towards the Law Society of Scotland; particularly in their representation of the profession in these matters.

It has been reported that there was to be a challenge lodged to the Society?s position as the sole representative body of Solicitors in Scotland which will be founded upon Article 11 of the European Convention on Human Rights.? I am not a solicitor and I have not had many dealings with the Law Society of Scotland.? I only know what others have told me (and I?m not inclined to make my own decision purely upon the basis of third party complaints).? However, it has always been something that has intrigued me about the legal profession.? I?m a supporter of Trade Unions and the representative functions that they undertake.? However, I?m equally supportive of a person?s right to choose their representative body (and to elect not to belong to such a body).? That goes not just for lawyers, but for others who have a single statutory representative body with no choice as to who they have representing them.

I think it is only right that if people want a different representative body that this is a choice that they have.? It will be interesting to see if this case goes ahead and what the outcome of it might be; it could have a profound effect on the United Kingdom extending beyond the legal profession.

The fight to ensure justice in Scotland will no doubt continue as the programme for reform of the criminal justice system continues over the coming years.? There are proposals in the pipeline that will likely gain similar; if not greater, reactions from the legal profession (corroboration and contracting to name two).? It?s an unsettling time in the criminal law for Scotland; but it?s an equally interesting one.

Sweet 16 Party Ideas : Ideas for Women Home and Family Blog

If you have a daughter then you will be planning a Sweet 16 Birthday party at some point. It is one of the biggest moments in a girls life. There are many parents who go all out for this particular birthday having a prom like party. Depending on your culture this may be the way you go. There are of course some other themes and ideas to choose from.

  1. Tropical/Luau Theme: This is fairly popular where everything looks like Hawaii.
  2. Wonderland Tea Party: I really like this theme because everything looks like the Tea Party Scene from Alice in Wonderland. You can really have a great time with this.
  3. Spa Party: Set up stations where everyone can get mani and pedicures.
  4. Scavenger Hunt: Have everyone drive around looking things. This is a ton of fun and can be done in teams.

These are of course just a few of the million of themes that you can plan. As I said before many go the prom like route with everyone dressing up and the event being formal. The girl turning 16 usually wears a white dress (although this tradition has changed during recent years) and she wears a tiara or crown as well. The ideas is that she is queen of the ball.

Mantel's history novel picks up another major award

LONDON (Reuters) - British novelist Hilary Mantel added to her groaning trophy cabinet on Tuesday, picking up the Costa Book Award 2012 for "Bring Up the Bodies," her historical novel about the life and court of Henry VIII and his chief minister Thomas Cromwell.

The acclaimed bestseller has already won the Man Booker prize for fiction, making Mantel the first Briton and first woman to win that coveted award twice.

The 60-year-old also won the Booker Prize in 2009 for "Wolf Hall," the first instalment in what will be a trilogy.

Broadcaster Jenni Murray, chair of the nine-member panel who decided which of five Costa category winners would take the overall prize, said "Bring Up the Bodies" stood "head and shoulders" above the rest.

"This is a very difficult prize to judge, because there are five categories and they are so different," she told reporters ahead of a reception in London announcing the winner.

"It's not an easy prize to judge, but I have to say today one book simply stood head and shoulders - more than head and shoulders, on stilts - above the rest."

Mantel had been the bookmakers' favourite for the award, which comes with a cheque for 30,000 pounds ($47,000). Category winners each win 5,000 pounds.

Asked whether the judges had considered giving the prize to another author to spread the spoils of literary awards, which usually bring with them a sizeable spike in sales, she replied:

"We know this has had lots of prizes. We couldn't allow the number of times it's already been lauded to affect our decision. It was quite simply the best book."

Murray praised what she called the "poetic" prose of the novel, which traces the downfall of Anne Boleyn in 16th century England and Henry's dangerous attraction to Jane Seymour.

"It's so set in its time so you know exactly where you are and who you are with, but it's also incredibly modern," she said. "I have no doubt that I want to go back to it. I've read it twice and I want to read it again."

ALL-FEMALE SHORTLIST

"Bring Up the Bodies," which like Wolf Hall will be adapted for the stage by the Royal Shakespeare Company, was one of an all-female shortlist in 2012.

Journalist, critic and writer Francesca Segal's debut novel "The Innocents," set in a Jewish community in northwest London and modelled on Edith Wharton's "The Age of Innocence," won the Costa First Novel Award.

Scottish poet Kathleen Jamie won the poetry prize for her collection "The Overhaul," and writer/illustrator and dyslexia campaigner Sally Gardner claimed the Costa Children's Book Award for "Maggot Moon."

Husband-and-wife team Bryan and Mary Talbot jointly won the Costa Biography Award for "Dotter of her Father's Eyes," a biography of James Joyce's daughter interwoven with a memoir of the author's own troubled relationship with her father, Joycean scholar James S. Atherton.

Mary Talbot, a scholar and author, teamed up with Bryan, who has worked on underground comics and superhero stories including "Judge Dredd" and "Batman: Legends of the Dark Knight".

Their collaboration was the first graphic work to win a Costa category award.

The Costa awards go to writers based in the UK and Ireland for a work published in the last year. They were established in 1971 by Whitbread but were renamed after Costa Coffee took over the sponsorship.

The 2011 Costa Book of the Year was "Pure" by Andrew Miller.

U.S. Azeris Network launches awareness campaign on Azerspace-1 ...

U.S. Azeris Network (USAN) launched a campaign to raise awareness about the successful project of Azerspace-1, the first Azerbaijani satellite to be launched in February 2013, AzerTac state news agencv reported.

Members of Azerbaijani-American community will send the letter prepared by USAN to U.S. legislators and media to inform them about enhancement of bilateral trade between the United States and Azerbaijan, including in non-oil sectors such as aviation, satellite, telecommunications, real estate, gold mining, financial services and equity investments and ask the lawmakers to facilitate these developments and encourage the mutually beneficial relations.

Built by the Virginia-based Orbital Sciences Corp. in the United States, the Azerspace-1 satellite has been a success story and has already been delivered to the launch site, where it will be launched on February 8 into space. Azerbaijan signed a contract with Orbital Sciences Corporation to design, build, and deliver its first communications satellite in June 2010. This contract is worth $230 million, and created 1,500 new American jobs, most of them in Virginia.

According to a January 2012 report by the Aerospace Industries Association, the U.S. share of the global satellite manufacturing market has dropped from 65 percent to as low as 30 percent since 1999. The report says U.S. companies lost $21 billion between 1999 and 2009 due to the export regime at a cost of 9,000 jobs annually. Now this is changing, and the Azerbaijani satellite is a trailblazer.

The Azerspace-1 satellite will offer telecommunication services to Eastern Europe, the Caucasus, Central Asia and North Africa, providing digital broadcasting, Internet access, data transmission, creation of VSAT multiservice networks and communications. Some 20% of the satellite`s resources will be used for Azerbaijan`s needs, and the remaining 80% will be available for commercial purposes, including for U.S. government and private customers, such as in Afghanistan, Iraq, and Central Asia. After launching Azerspace-1, all of the territory of Azerbaijan, including its Nakhchivan exclave and Karabakh region, will be covered with quality TV and radio broadcasting, high-speed IP services, enabling a stable and quality platform for programs such as distance education and e-health, eliminating communication problems.

Azerbaijan also intends to launch its second satellite into the orbit in 2015, followed by a third telecommunication satellite in 2016. So there are still ample opportunities for more U.S. companies and states to sign lucrative contracts on designing, building and delivering these satellites as well as other products and services.

J.C. Penney looks to sales to lure back shoppers

7 hrs.

J.C. Penney is bringing back sales.?

The struggling department store chain this week will begin adding back some of the hundreds of sales it ditched last year in hopes of luring shoppers who were turned off when the discounts disappeared, CEO Ron Johnson told The Associated Press.?

Penney also plans to add price tags or signs for more than half of its merchandise to show customers how much they're saving by shopping at the chain ? a strategy used by a few other retailers. For store-branded items such as Arizona, Penney will show comparison prices from competitors.?

The reversal comes on the eve of the one-year anniversary of its original vow to almost completely get rid of the sales that Americans covet but that cut into a store's profits. The idea was to offer everyday low prices that customers could count on rather than the nearly 600 fleeting discounts, coupons and sales it once offered.?

The bold plan has been closely watched by others in the retail industry, which commonly offers deep discounts to draw shoppers. But so far the experiment has served as a cautionary tale of how difficult it is to change shoppers' habits: Penney next month is expected to report its fourth consecutive quarter of big sales drops and net losses. After losing more than half of its value, Penney's stock is trading at about $19. And the company's credit ratings are in junk status.?

Johnson, who rolled out the pricing plan shortly after taking the top job in November 2011, told The Associated Press the latest moves are not a "deviation" from his strategy but rather an "evolution."?

"Our sales have gone backward a little more than we expected, but that doesn't change the vision or the strategy," said Johnson, who previously masterminded Apple Inc.'s retail stores and Target Corp.'s cheap chic fashion strategy. "We made changes and we learned an incredible amount. That is what's informing our tactics as we go forward."?

But critics say Johnson is backpedaling. Walter Loeb, a New York-based retail consultant, said Johnson "is now realizing that he has to be more promotional to attract shoppers."?

The pricing strategy has been a key part of Johnson's plan to reinvent Penney, which had failed to change with the times as its competitors updated their stores to make them cool places to shop. The plan includes adding hip new brands such as Joe Fresh and replacing racks of clothing with small shops-within-stores by 2015. But this isn't the first time the pricing strategy has been tweaked.?

When it was rolled out in February 2012, the plan entailed permanently slashing prices on everything in the store by 40 percent. Penney decided to have just 12 monthlong sales events on some merchandise. And there would be periodic clearance events throughout the year.?

But the new pricing plan wasn't well received on Wall Street or Main Street, so six months after launching it, Johnson ditched the monthlong sales, saying that they were too confusing to shoppers. Johnson said Penney has learned that people don't shop on a monthly basis, but rather they buy when they need something for say, back-to-school or during the winter holidays. And during those times, he said, they're looking for even more value.?

"I still believe that the customer knows the right price, but they want help," he said.?

Penney declined to say how many sales events it will offer going forward, citing competitive reasons. But the company said the figure will still be well below the nearly 600 it used to offer. The company said the discounts will vary depending on the sale. From Feb. 1 through Feb. 14, for instance, shoppers will get 20 percent off some jewelry for Valentine's Day. One example: half-carat diamond heart pendants on sale for $96, below Penny's everyday price of $120.?

Penney said the decision to add tags or signs on much of its merchandise that shows the "manufacturer's suggested retail price" alongside Penney's "everyday" price was a result of his realization that shoppers want a reference price to consider.?

National brands were also asking Penney to show the suggested price to shoppers, he said. Penney began showing the suggested manufacturer's price on Izod men's merchandise last fall and was encouraged by the response.?

Burt Flickinger, a retail consultant, said the move could help Penney because manufacturers' suggested retail prices can be as much as 40 percent higher than what retailers wind up charging. The practice is common in the home appliance industry but spotty in the department-store industry because stores generally hike prices up even more to give shoppers the illusion of a big discount, he said.?

"The strategy will be helpful for shoppers to understand lower prices," Flickinger said. "At the same time, it will be tough to get consumers back in the store from competitors."?

But Craig Johnson, another retail consultant, said that adding the suggested manufacturer's price is just a gimmick. "The objective of this exercise is to maximize the perceived value for the purchase."?

Johnson said that for Penney's own store brands like Arizona and Worthington, the team will research other stores and will submit supporting data to its legal team for approval before it advertises comparison prices, using certain criteria. For example, they'll make sure the fabric used is of the same quality as its rivals. For jewelry, Penney is using the International Gemological Institute, a third-party appraiser.?

"There are no makeup prices here," Johnson said. "It's all about trying to communicate what it's worth to the customer."?

Penney will not show comparison prices for merchandise that is part of exclusive partnerships with brands such as Nicole Miller and Mango, however. The company said it's difficult to offer such references.?

To promote the strategy, Penney on Wednesday will begin launching TV, print and digital ads. One TV ad compares a $9 polo shirt under its store brand Arizona with $19 "elsewhere." "Two polos, same color, same vibrant, same details, same swing, same swagger, different prices," the ad said.?

Johnson reiterated that he expects Penney to return to sales growth sometime in 2013. That would be a welcome change for Penney, which has had steep sales and profit losses since the new strategy was launched.?

For the first nine months of its current fiscal year, Penney lost $433 million, or $1.98 per share compared with a loss of $65 million, or 30 cents per share in the year-ago period. Total sales dropped 23.1 percent to $9.1 billion.?

Analysts expect Penney to post a loss of 17 cents on sales of $4.22 billion for the fourth quarter. They expect the company's annual sales to fall by 23 percent, or nearly $4 billion, to $13.3 billion for the latest year. Revenue at stores opened at least a year ? a measure of a retailer's health ? are expected to drop 25 percent, in line with the third quarter, according to analyst polled by research firm FactSet.?

Meanwhile, investors have sent shares down more than 55 percent from a peak of $43 in the days after the plan was rolled out in February. Shares slipped 18 cents to $19.17 on Monday.?

"A year ago, we were launching a major transformation and didn't know what to expect," he said. "Today, I know what happened. Our team has a year's worth of history. This is going to be a great year because the new JCP is coming to life for customers."?

No one likes to be in debt, but?taking out personal loans from time to time?is often necessary, especially if the loan is for an investment ? e.g. to buy a first house, finance your education, or get a start-up business off the ground.??? There are well-documented problems that borrowers can encounter with high-interest loans, whether that is caused by poor financial management, or taking out a reasonable loan but not understanding the terms. Even if we are unable to pay a loan back as quickly as we had initially agreed, there is help available for borrowers to consolidate their debt and get out from underneath it. In certain states and counties, debtors who get behind on their payments can actually wind up in private prisons run by contractors, even though debtors? prisons have been mostly illegal in the USA since the Civil War. However, if you find yourself blessed with friends or family who have disposable cash to hand (and like you), there is a great temptation to take a loan from a personal acquaintance instead of a bank or lending institution. And, it makes sense: it's often quicker and easier, with less red tape and better terms (perhaps your friend or family member has even offered to let you pay back the loan interest-fee), and on a whole, it somehow feels less scary; no paper-work or intimidating payment reminders from the bank. But as they say, buyer beware. The danger with borrowing money from someone you know is that money can become a divisive issue; indeed, it is an issue that has been known to destroy relationships and ruin friendships. In fact, an overwhelming number of marital problems and divorces are down to money-related conflicts, which should serve as a strong caution to even the most amiable friend or relative who might offer you financial help. One major stumbling block with family loans is that people may not be honest with you ? i.e., the money may be more important to them than they initially indicate. The importance of recouping that money, and the lender?s expectations as to how quickly you'll pay them back, often goes unstated. Furthermore, you may take their generosity for granted and assume they'll 'let it slide' or that they'll understand if you can't make your repayments every month. It is easy to allow one month of non-payment turn into two months or four; sometimes, it turns into a year, with the hope or assumption that the loan has been forgiven. It is easy to imagine how this might fracture the relationship. An interesting?study was conducted by Carnegie Mellon University?? we have a tendency, especially in situations where we are borrowing money from a friend or family member, to confuse fairness with self-interest. So at the end of the day, which is more important to you: money or your relationships? How about you all? Would you be willing to give a loan to a family member or have you ever taken out one of these? If so, how did it work? Did it create any family stress? Did you have a written agreement?

U.S. grapples with Egypt's Islamist turn

WASHINGTON (AP) ? President Barack Obama begins his second term straining to maintain a good relationship with Egypt, an important U.S. ally whose president is a conservative Islamist walking a fine line between acting as a moderate peace broker and keeping his Muslim Brotherhood party happy with anti-American rhetoric.

The White House last summer had hoped to smooth over some of the traditional tensions between Washington and the Brotherhood, a party rooted in opposition to Israel and the U.S., when Egypt overthrew dictator Hosni Mubarak and picked Mohammed Morsi as its first democratically elected leader.

But a spate of recent steps ? from Brotherhood-led attacks on protesters, to vague protestations of women's freedoms in the nation's new constitution, to revelations of old comments by Morsi referring to Jews as "bloodsuckers" and "pigs" ? have raised alarm among senior U.S. officials and threatens $1 billion in American aid to Egypt.

Though the Brotherhood was founded in Egypt, its influence and affiliates have spread across the Mideast and into North Africa ? where two recent terrorist attacks and a French assault on Islamist militants in Mali have presented Obama with a new front in the battle against extremism for his second term.

The White House has little interest in picking a fight with the Muslim Brotherhood, which has grown in size and stature across the region since the Arab Spring revolts. The Brotherhood and similar Islamist movements are regarded warily by monarchies in Jordan, Kuwait, Saudi Arabia, the United Arab Emirates and Morocco. Its members are part of the opposition coalition seeking to oust Syrian President Bashar Assad. It has small followings in Qatar, Algeria, and a like-minded ? although not officially affiliated ? ally in Tunisia.

When Egyptians elected Morsi, he offered words of moderation, brokered a cease-fire between Israelis and Palestinians in Gaza and bore down on terrorist dens in the Sinai Peninsula.

The Morsi-led government is "a new administration and they're obviously having growing pains," said a senior Obama administration official who agreed to speak on condition of anonymity so he could discuss the diplomatic relationship more candidly.

Since the Tahrir Square revolution two years ago, Washington has tried to help Egypt build a democratic state without appearing to tread on its sovereignty. Morsi won election last June with 51 percent of Egypt's vote.

A new eruption of political violence in Egypt over the weekend left about 50 people dead, deepening the malaise as the Morsi struggles to get a grip on enormous social and economic problems. He has declared a 30-day state of emergency and curfew in the three Suez Canal provinces hit hardest by the violence.

The White House is increasingly concerned about the direction the Brotherhood is taking Egypt: "It's not just about majority rule," the administration official said. "There are democratic principles that we continue to support."

Morsi's anti-Semitic comments, made in separate speeches in 2010 but which surfaced this month on Egyptian TV, also accused Obama of being a liar. They shocked U.S. officials who sprang to condemn them as counter-productive to American-supported peace efforts in the Mideast. But they surprised few people in Egypt, who have heard Brotherhood officials make similar statements for years.

Morsi initially struggled to respond to the U.S. backlash from the comments. His office issued a statement committing to uphold religious freedoms and tolerance, and condemning violence.

"The president strongly believes that we must respect and indeed celebrate our common humanity, and does not accept or condone derogatory statements regarding any religious or ethnic group," the statement said, without addressing the fact that Morsi himself made those comments.

The statement, however, did little to soothe U.S. lawmakers ? Democrats and Republicans alike ? who have balked at approving $1 billion in aid to Egypt that Obama promised in 2011 to help the new government settle an economic crisis that has drained the country's central bank and devalued the local currency in the revolution's aftermath.

"How would the American people feel about cutting money to education programs here and giving money to a government that is anti-Semitic?" Rep. Frank Wolf, R-Va., a member of the House Appropriations subcommittee that oversees funding to foreign governments, said.

"I don't think the administration has any right to say they are going to grant this foreign aid because I think this Congress may very well condition it," Wolf said. "I think there are a lot of questions, and I don't think it's a given."

Part of the proposed $1 billion aid package depends on International Monetary Fund approval of its own $4.8 billion loan to Egypt. But that loan has stalled for months because of Egypt's instability.

Despite its misgivings about Morsi, the White House still is pushing Congress for the funding, acknowledging that Egypt's downfall all but certainly would roil the already turbulent Mideast and North Africa.

"It's not in our interest to have an economic collapse in Egypt," said the senior Obama administration official.

The Brotherhood describes itself as a non-violent social organization dedicated to instilling Islamic values in the society. In Egypt, where it formed, the group was repressed by former regimes for decades and has struggled with adjusting to its new role leading the government. Its members, fearing a coup, are widely blamed with attacking anti-Morsi protesters outside the presidential palace in Cairo last month in clashes that left at least 10 people dead.

"What they missed was the fact that they are a governing party now, and to be getting into street battles when you also have commanding presence in the Egyptian state shows inexperience and panic," said Nathan Brown, a professor at George Washington University who has been researching Islamic movements for nearly a decade. "This is the kind of group that will be a pain to deal with for the United States, but it's not al-Qaida; it's not a security threat."

He added: "The biggest fear on the part of the (Obama) administration is a political breakdown in Egypt. They are worried that a collapse in the Egyptian state would be destabilizing on the region, and might allow the flow of arms and fighters among more radical movements in the region ? especially in trouble spots like Sinai and Gaza."

Obama administration officials said Morsi's promises to abide by Egypt's 1979 peace treaty with Israel, and continued security cooperation with Israel over the volatile Sinai Peninsula shows his willingness to be a reasonable partner. Morsi's work in November to broker a cease-fire between Israel and Gaza's Hamas rules was "a good first step," the senior Obama administration official said.

But Washington remains wary of Morsi and the Muslim Brotherhood, "who come from a very conservative viewpoint with issues that are very important to America," said Sen. Kirsten Gillibrand, D-N.Y.

Gillibrand was part of a delegation of U.S. lawmakers who met with Morsi in Cairo this month shortly after his 2010 statements surfaced. She stopped short of saying Morsi appeared chastened but described him as mindful of "how important America is to the viability of his presidency and the economy."

She said lawmakers want to see what actions he takes, "and we want to see if his words match those deeds and actions," Gillibrand said.

Roadside bomb kills 10 in Afghanistan

KANDAHAR, Afghanistan (AP) ? A police truck packed with officers and detainees struck a roadside bomb in southern Afghanistan's largest city, killing 10 of those aboard, officials said Sunday.

It was one of four blasts Saturday that left at least 24 people dead across the country. Attacks by insurgents are a daily occurrence around Afghanistan and the Afghan police with their unarmored pickup trucks and remote checkpoints are a common target.

In the Kandahar city blast, police had driven to a residential neighborhood of the city at night to inspect a bomb that had been found there, said Javid Faisal, a spokesman for the provincial government. They detained three suspects and were driving back with them in a police pickup truck when the vehicle struck another explosive buried in the road. Eight police officers and two detainees were killed in the blast.

Meanwhile, Afghan authorities accused NATO of killing three civilian men in a nighttime ambush in the eastern Logar province. The coalition disputed the account, saying it had no operations in Logar's Baraki Barak district Saturday night. NATO said there were three dead, but they were insurgents killed by Afghan forces.

Deputy provincial police chief Rais Khan Abdul Rahimzai said all three of the added were civilians. "They were brothers. They had dinner at one of their brother's houses in another part of the district and it was when they were driving back that they were ambushed by the foreign soldiers," Rahimzai said. "It was a misunderstanding in which foreign forces shot and killed three people."

A spokesman for the international force disputed the Afghan version of the incident. "This was the ANSF," said Maj. Martyn Crighton, referring to the Afghan National Security Forces. He said they went after three men who had been seen burying a bomb in the ground and "got engaged in a firefight with these guys."

It was not possible to reconcile the conflicting accounts.

Earlier Saturday, 10 policemen were killed when a suicide bomber on a motorcycle blew himself up in Kunduz province in the north. Elsewhere, a remote-controlled bomb planted on a bicycle exploded in the eastern city of Ghazni, killing one police officer and a civilian. And in the west, officials in Farah province said Sunday that two police officers were killed there Saturday evening when their vehicle hit a roadside bomb.

On Sunday in the south, a roadside bomb in the town of Marjah killed another three police officers, said Ahmad Zarak, a spokesman for the Helmand provincial government.

French forces take airport, bridge in Gao, Mali

SEVARE, Mali (AP) ? French forces took control of the airport and a key bridge in the radical Islamist stronghold of Gao under the cover of darkness early Saturday, marking a significant inroad into the heart of territory held by the al-Qaida-linked extremists.

The move comes just two weeks after France launched its military offensive to rout the Islamists from power in northern Mali. It is unclear what kind of resistance they will face in the coming days

French and Malian forces came under fire in the morning and continued to face sporadic "acts of harassment," in the afternoon, said Col. Thierry Burkhard, a French military spokesman in Paris. He had no immediate estimate on casualties.

The Islamists first seized control of Gao and two other northen provinicial capitals ? Timbuktu and Kidal ? in April last year during the chaotic aftermath of a coup in the distant capital.

French Defense Minister Jean-Yves Le Drian announced in a statement from his ministry Saturday that jihadist fighters who encountered the advancing French and Malian troops "saw their means of transport and their logistics sites destroyed."

Before the joint air-land operations overnight, French forces carried out "an important phase of air strikes" around Gao and Timbuktu, with nearly 30 bombs fired from fighter jets over the previous two days, the military said.

More French and African troops and equipment were being sent to Gao, announced the French defense ministry. Troops from Chad and Niger "should arrive in the Gao area very soon," it added.

Elsewhere in Mali, French and Malian troops supported by a tactical air group carried out a night-time "reconnaissance offensive" toward Lere, "where several terrorist elements were noticed a few days earlier," the military said.

Two Rafale jets have been added to the campaign, bringing France's total deployment to 12 fighter jets as part of the code-named Operation Serval in Mali, the military said.

Nouhoum Maiga, a deputy mayor in Gao, confirmed Saturday that the French had come by land and air late Friday.

Gao has been under the control of the al-Qaida-linked Movement for Oneness and Jihad, or MUJAO, for months.

On Friday in a show of might, the Islamist radicals destroyed a bridge near the Niger border with explosives, showing that the extremists still remain a nimble and daunting enemy.

Since France began its military operation two weeks ago with a barrage of airstrikes followed by a land assault, the Islamists have retreated from three cities in central Mali: Diabaly, Konna and Douentza.

The Islamists, though, have maintained control of the majority of the territory in Mali's north, most importantly the cities of Gao, Kidal and Timbuktu.

The announcement that Gao's airport had been taken marked the first official confirmation that French and Malian forces had reached the city. Previously the closest they had been was Hombori, a town some 155 miles (250 kilometers) away.

The French currently have about 2,500 forces in the country and have said that they will stay as long as needed in Mali, a former French colony. However, they have called for African nations to take the lead in fortifying the Malian army's efforts.

There are currently some 1,750 troops from neighboring African countries, including Togo, Nigeria, Burkina Faso, Benin, Senegal, Niger and Chad.

The French-led mission began after the Islamists surged the farthest south yet and took the town of Konna. On Saturday, the Malian military allowed international journalists to enter the town for the first time since the conflict began.

Residents described the civilian casualties that took place during the French air strikes, including one that left three women and a child dead. Officials have said at least 11 Malians died in the military effort to retake the town.

Souleymane Maiga said the women were preparing food in the courtyard underneath a mango tree when he heard the helicopters overhead.

"I ran and hid between the walls of our courtyard," he said. "After it was over, I went to the house and I opened the door and that's when I saw that they were dead."

Only a toddler survived, Maiga said.

"They were one on top of the other. The baby was crying," he said. "I tried to feel for a pulse to see if there was any life, but I found that they were all dead."

Court says EPA overestimates biofuels production

WASHINGTON (AP) ? A federal appeals court has ruled that the Environmental Protection Agency is overestimating the amount of fuel that can be produced from grasses, wood and other nonfood plants in an effort to promote a fledgling biofuels industry.

At issue is a 2007 renewable fuels law that requires a certain amount of those types of fuels, called cellulosic biofuels, to be mixed in with gasoline each year. Despite annual EPA projections that the industry would produce small amounts of the biofuels, none of that production materialized.

There have been high hopes in Washington that the cellulosic industry would take off as farmers, food manufacturers and others blamed the skyrocketing production of corn ethanol fuel for higher food prices. Those groups said the diversion of corn crops for fuel production raised prices for animal feed and eventually for consumers at the grocery store. Lawmakers hoped that nonfood sources like switchgrass or corn husks could be used instead, though the industry hadn't yet gotten off the ground.

The 2007 law mandated that billions of gallons of annual production of corn ethanol be mixed with gasoline, eventually transitioning those annual requirements to include more of the nonfood, cellulosic materials to produce the biofuels. As criticism of ethanol has increased, lawmakers and even Presidents George W. Bush and Barack Obama have talked of the cellulosic materials as the future of biofuels.

But the cellulosic industry stalled in the bad economy and still hasn't produced much. According to final EPA estimates, no cellulosic fuel was produced in 2010 or 2011. Last year's estimates aren't yet available.

"What you have in our industry is a technology that is ready to go but has had a hard time punching through commercially because of a very challenging global financial climate," said Brooke Coleman of the Advanced Ethanol Council, which represents companies trying to produce cellulosic fuel. Coleman said there are better hopes for 2013 as several plants are coming online.

The court faulted the EPA for setting last year's projections at 8.7 million gallons even though the two previous years had shown no production, and also for writing in the rule that "our intention is to balance such uncertainty with the objective of promoting growth in the industry."

Judge Stephen Williams on Friday threw out the too-high EPA estimates in response to a challenge filed by the American Petroleum Institute, which represents the oil industry.

Williams, an appointee of President Ronald Reagan, said the law was not intended to allow the EPA "let its aspirations for a self-fulfilling prophecy divert it from a neutral methodology."

The court rejected the oil industry's arguments that the EPA also should have lowered the total production requirement for renewable fuels once the cellulosic goals were not met, saying the EPA had authority to decide to maintain those requirements.

An EPA spokeswoman would only say the agency will "determine next steps." The oil industry praised the decision.

"The courts have reined in a mandate for biofuels that don't exist," said Bob Greco of the American Petroleum Institute. "It's a voice of reason."

Home ? General ? Politics ? Ayotte to reintroduce legislation shielding Internet businesses from sales taxes

    By Staff Reporter

    January 24, 2013

New Hampshire Senator Kelly Ayotte is getting set to continue opposing attempts by the federal government requiring online retailers to collect sales taxes for ?other jurisdictions in which they do not have a physical presence.?

According to a press release from her office, Ayotte is crossing the aisle and working Democratic Senator Ron Wyden of Oregon to ?reintroduce a resolution expressing the sense of the Senate that no federal legislation should give states the authority to impose any new burdensome or unfair tax collecting requirements on Internet businesses and entrepreneurs.?

Currently, a Supreme Court ruling has maintained that a state can?t compel out-of-state, Internet-based vendors to collect the same sales taxes as in-state brick and mortar business owners. But efforts at both the state and federal level have persisted, and Ayotte is again addressing the issue after introducing a similar resolution last year.

Ayotte took a very New Hampshire-centric tone, citing concerns that sales tax collections from out-of-state online retailers would infringe upon the Granite State?s sales tax free status.

?Online businesses should be a source of jobs, not a source of new tax revenue. New Hampshire prides itself on having no sales tax, and our Internet retailers shouldn?t be forced to become tax collectors for other states,? she stated in the press release. ?We need to be vigilant to preserve our tax-free status, and I will continue to fight any federal effort that would require New Hampshire Internet businesses to collect sales taxes.?

Old Course Hotel, Golf Resort & Spa from the Swilken Bridge

The five red star Old Course Hotel, Golf Resort & Spa in St Andrews is celebrating ?the best possible start? to 2013 with three very high profile awards.

VisitScotland has acknowledged the ?exceptional standards? at the Home of Golf resort with five gold stars through its national tourism Quality Assurance Scheme. Richard Pinn, VisitScotland Regional Director, explains: ?Our gold award recognises serviced accommodation businesses across Scotland that consistently achieve the highest levels of excellence. Businesses achieving this prestigious award excel in customer care and hospitality and show real commitment to staff development and training.? Richard adds: ?Establishments such as the Old Course Hotel, Golf Resort & Spa are the stand-out businesses when it comes to exceptional quality and service in providing accommodation for visitors. It is a real pleasure to make this announcement ? and we congratulate all at the St Andrews resort.?

The iconic resort has also been recognised by Cond? Nast Traveler in their ?Platinum Circle?, an award for destinations that have made their gold list every year for five consecutive years. The 144 bedroomed hotel scores highly with those voting for the award, achieving over 90% for the ?killer location?, ?Jacques Garcia-designed rooms? and the array of activities available to guests. The service provided by the resort staff is complimented as ?courteous, prompt and professional? and the award-winning Kohler Waters Spa, the three AA rosette Road Hole Restaurant and the world famous Road Hole Bar all receive mentions within the award summary. And hot on the heels of the Gold & Platinum recognition is the resort?s inclusion in the exclusive Travel & Leisure?s Top 500 Worldwide Resorts ? the Old Course Hotel being the only destination recognised in Scotland.

General Manager, Daniel Pereira, is ?absolutely delighted? with the news, saying: ?Awards are always welcome, but accolades that recognise our ongoing commitment and investment in our staff and training are especially welcome.?

Daniel adds: ?Recognition from those who travel the world and stay in destinations around the globe are also very highly valued as they truly reflect the customers? view. When we share news of this kind, it helps to show that the resort is so much more than a hotel. It is the day-to-day enthusiasm, dedication and commitment from our entire team that results in such recognition, benefiting not just the resort but also our many local, regional and Scottish suppliers as well as the wider tourism market. It is wonderful news of which we are enormously proud ? and the best possible start to 2013.?

Most Americans back Obama on gun control plan

Most Americans respond positively to the stricter gun control measures Barack Obama proposed last week in the wake of the tragic shootings in Newtown, Conn. - but by less of a margin than such measures receive outside the context of partisan politics.

Fifty-three percent in the latest ABC News/Washington Post poll view Obama's gun control plan favorably, 41 percent unfavorably. Strong proponents outnumber strong opponents by 38 vs. 31 percent in this poll, produced for ABC by Langer Research Associates.

See PDF with full results here.

Obama urged measures including background checks on all guns sales, reinstating the assault weapons ban, banning high-capacity ammunition magazines and armor-piercing bullets, new gun trafficking laws and increased access to mental health treatment.

Support for the package is lower than it was for some of the same steps tested individually in an ABC/Post poll earlier this month. Majorities from 88 to 65 percent favored background checks at gun shows and on ammunition purchases, creating a federal database to track gun sales and banning high-capacity magazines. That included, in each case, majorities of Democrats, Republicans and independents alike.

In this poll, asking about "Barack Obama's proposals for stricter gun control," partisan allegiances kick in. The president's proposals are seen favorably by 76 percent of Democrats but unfavorably by 72 percent of Republicans; most on each side feel strongly about their respective positions. Independents split 51-44 percent, favorable-unfavorable.

What remains to be seen is whether the president can overcome those partisan predispositions in his efforts to encourage Congress to pass the legislation he seeks.

Among other groups, Obama's proposals are viewed positively by 56 percent of women vs. 49 percent of men; 58 percent of seniors vs. 47 percent of young adults; 66 percent in the Northeast vs. 50 percent in the rest of the country; 72 percent of nonwhites vs. 43 percent of whites; and 73 percent of liberals vs. 36 percent of conservatives.

The survey was done by landline and cellular telephone Jan. 16-20 among a random national sample of 1,033 adults, and the results have a 3.5 point-error margin.

Astronomers report largest structure in universe. Will it upend theories?

Recent work suggests that the upper limit to the largest gatherings of galaxies is about 1.2 billion to 1.5 billion light-years across. The structure that the team reports is nearly four times this theoretical limit.

This artist?s impression shows how ULAS J1120+0641, a very distant quasar powered by a black hole with a mass two billion times that of the Sun, may have looked. This quasar is the most distant yet found and is seen as it was just 770 million years after the Big Bang. This object is by far the brightest object yet discovered in the early Universe.

What could be the largest structure yet seen in the observable universe has emerged from data taken during a 12-year survey of the night sky.

The discovery is an apparent cluster of quasars some 4 billion light-years across. If it holds up to further scrutiny, it could challenge a long-held assumption that at the cosmos's largest scales, the physical processes at work and the distribution of matter and energy are the same, regardless of an observer's location.

That's the view of the team formally reporting the results Friday in the journal Monthly Notices of the Royal Astronomical Society.

Quasars are the hyperactive centers of large galaxies and are among the brightest, most energetic objects in the sky. Some recent theoretical work suggests that the upper limit to the largest gatherings of galaxies is about 1.2 billion to 1.5 billion light-years across. The structure that the team reports is nearly four times larger than this theoretical limit.

Other researchers caution that evidence in the new discovery isn't strong enough to challenge this notion of large-scale uniformity, dubbed the cosmological principle.

But, they add, the work does highlight a key question in modern cosmology: What is the size scale at which the wildly uneven distribution of matter seen at small cosmic scales gives way to a uniform average across the universe as a whole?

"We don't know that," says Margaret Geller, an astronomer at the Harvard-Smithsonian Center for Astrophysics in Cambridge, Mass., whose research focuses on how the universe and its cosmic-scale structures formed and evolved. "And this is an indication that we don't know that."

Astronomers snagged their first large cluster of quasars in 1982, says Roger Clowes, an astronomer at the University of Central Lancashire in Britain and the leader of the research team reporting the new results. By 1991, two more large clusters had been found. With the advent of the Sloan Digital Sky Survey in 2000, more have appeared, including the latest discovery.
